Divorce Mediation: A Cost-Effective Alternative to Litigation
Divorce mediation is an alternative to the traditional method of going
to court to obtain a
divorce. For many couples, it provides a way to avoid the emotional and financial
cost of litigation. Mediation is a fair and cost-effective solution that
enables divorcing spouses to get closure while, at the same time, ensuring
that someone will adequately address their concerns. Although many attorneys
encourage their clients to fight, we want you to know that there is an
effective alternative: divorce mediation.
At Lois M. Brenner, Esq., we believe that divorce mediation should often
be the first option for separating or divorcing spouses. In mediation,
an experienced, well-trained, and neutral mediator will help facilitate
productive conversations between the parties and, through a series of
sessions, help them reach an agreement that works for their family. We
have found that when two partners sit down and craft an agreement together,
they are much more likely to comply with the terms thereof. It is surprising
how often this works at our office.
Is Divorce Mediation Right for Me?
Under the right circumstances, and with the right mediator who understands
psychology, divorce mediation can be stunningly effective; however, it is not a panacea
for every family dispute. In some cases, a couple simply can’t imagine
coexisting in the same room during negotiations, or they feel they each
need an ally. Some people who mediate check in with a lawyer separately
to make sure they know what they are entitled to.
Mediation is not a cure-all for every case, but in the majority of the
cases that come through our doors, it should at least be attempted. Even
if the couple’s first mediation session consists of expressions
of anger, it does not necessarily mean that the mediation process will
not eventually succeed. Under the guidance of an expert mediator, spouses
can be helped to make a deal.
Here are some of the most important things to remember about mediation:
- Your divorce may only take weeks or months to resolve
- Mediation is often the least expensive form of divorce
- Hiring your own divorce attorney may not be necessary
- Mediation is generally the least adversarial form of divorce
- You and your spouse will have the chance to cooperate and remain less adversarial
