As a divorce attorney and psychologically trained mediator, I hear all kinds of diverse divorce stories. I have decided to share some of these stories monthly with you.

Naturally, I will change the names and some of the details to protect the privacy of my clients. The purpose of sharing these divorce stories with you is to let you know you are not alone. There are peaceful, rational solutions available to you. You really can have a happily-ever-after.

Justin and Ava were married for 9 years. They had triplets, age 6. They were both professionals. He was a finance trader, she a marketer. They lived in Manhattan and had a large country home in East Hampton. When I received a phone call from Justin he was very emotional and not very happy. His wife had brought up divorce in a recent conversation.

She said she was going to call an attorney and wanted a divorce. She was not happy in the marriage and didn’t want to be married anymore.

Justin was shocked and didn’t see any of this coming. He suspected that there was more to her wanting to leave than she just didn’t want to be married anymore. He also explained he really didn’t want a divorce.

I suggested he speak with his wife about mediation as an option to discuss things and perhaps find a solution to holding on to the marriage with some conditions like using a postnuptial agreement to address some of the issues in the marriage.

He agreed and did speak with her. Ava was receptive to a conversation and when we spoke about the issues she verbalized what was really bothering her. Justin had cheated on her, which he had not mentioned to me, and she couldn’t trust him anymore. It had happened a few years earlier but it was still bothering her. Justin admitted it was a big mistake but also promised it would never happen again. We discussed how a postnuptial agreement might give Ava the security she would need to stay in the marriage. She admitted she did still love Justin but thought divorce was her only solution.

After a few conversations they agreed to a postnuptial agreement to try to save their marriage.

We discussed the details of the postnuptial agreement and the guidelines for what would happen if Justin cheated again. We included some financial parameters and consequences should infidelity occur again.

A postnuptial agreement was the perfect Band Aid for Justin and Ava. They wanted to save their marriage and this was the right vehicle.

When saving a marriage is possible, we always have to try. A postnuptial agreement gives the wounded party the security to give their marriage a second chance.

Justin and Ava have been doing well and I just received an email they had a new baby. I’m happy the postnuptial agreement is working and hopefully they will have a long and happy life together.
