New York Matrimonial Law Attorney
Matrimonial law, otherwise known as “family law,” relates to issues surrounding the nature of marriage, property division, entry into a marriage, children, termination of marriage, and child and spousal support.
Entry into Marriage
Matrimonial law deals with how couples enter into marriage by covering issues like prenuptial agreements and the legal requirements of a marriage. A prenuptial agreement can determine the rights of each spouse regarding marital property, child custody, spousal support, estate issues, separate property and other issues regarding the marriage. It is an agreement entered into between the spouses before the marriage.
Termination of Marriage
Matrimonial law in each state deals with issues regarding the termination of marriage by setting up rules about divorce and annulments. The family law of each state determines when an otherwise valid marriage can be terminated by divorce or when a marriage was never valid in the first place.
Child & Spousal Support
Matrimonial law in each state deals with issues regarding support of a person’s spouse and/or child by establishing formulas and criteria regarding child support and spousal maintenance. A state’s family and divorce law establishes the criteria regarding when someone needs to pay the support for the other spouse and/or for child support, how much needs to be paid, and for how long. There are also tax ramifications involved.

We were looking for a mediator to help us with visitation issues we were having due to the pandemic. I utilized Lois's services for divorce. She was most helpful in all aspects. First, she explored reconciliation, which was the right thing to do. Absence of that, her suggestion of what to negotiate for, how to do it without unnecessary anger & hostility to the ex & how to expedite the process was invaluable. We have Lois Brenner to thank for turning our marriage around. We hired Lois as our mediator when we were considering divorce. When we started working with her and she realized we wanted to try to keep our marriage together she suggested a postnuptial agreement to get our marriage back on track. Having the postnuptial agreement made us both accountable when it came to our issues. Having this doc in place is clearly helping us redefine our marriage in a better way. I don’t know if we will never get divorced, but for now we are respecting each others’ boundaries and are aware of the consequences if we don’t! It was really cool that Ms. Brenner suggested this method as an option. Most divorce attorneys would not have suggested a way for us to try to stay together.
