New York Grandparents’ Rights Lawyer
Seeking Visitation Rights? Call Lois M. Brenner, Esq. for Help.
For most grandparents, the idea of being unable to see their grandchildren is inconceivable. In reality, however, thousands of grandparents have faced the loss of their visitation rights. While some have successfully negotiated for the right to see their grandchildren, others have had to learn to live without regular contact. Currently, there is no uniform law in the United States regarding grandparents’ visitation rights – and, unfortunately, it is unlikely that there will be one in the near future.
If you need help seeking visitation with your grandchildren in New York, please do not hesitate to contact our New York family law attorney, Lois M. Brenner, Esq. You can reach our office at (646) 663-4546.
Grandparents’ Rights Are Decided By Each Individual State
Family matters are left up to the states to decide, and while some states have statutes providing for grandparent visitation, it does not make winning a case simple or easy. State laws regarding this issue vary from permissive to stringent, and many judges will consider case law when ruling on matters of grandparents’ rights. The Supreme Court case that relates to grandparents’ rights is Troxel v. Granville, which involved the right of third parties to seek visitation with children in Washington State.
In this case, Troxel v. Granville, the Supreme Court ruled that the statute was overly broad. As it had been written, the statute required only that such visits be in the best interests of the children. For this reason, the court decided that the statute violated a parent’s right to make decisions regarding the care, custody, and control of their children.

Thanks to Lois Brenner our wedding went well because we had our prenuptial agreement in place. We literally had her draft our prenuptial agreement 2 weeks before our wedding. She was thorough, made suggestions to include things we hadn’t even thought of, and got it done really quickly. Thanks Lois :)- Tanya S

What a gem! Lois Brenner is the best out there by far... She got my husband and I right away. Listened, guided, let me cry, and never gave up on us during our mediation sessions. It was not easy but she made it possible. Even my husband liked her and agreed to mediate after we had lots of arguments. Thank you Lois. I already recommended you to my cardiologist. Have a happy, productive New Year.- Bernie A.

Everything you said about mediation was true. My husband and I really connected in a positive way working out the details of our divorce in mediation with you. The arguing was endless but we finally heard each other. You have a lot of patience. The property discussions made everything so emotional. You kept us focused and stopped us from rehashing the past. We tell everyone about you. Hopefully none of our friends will divorce but if they do we will tell them they need you.- Tom & Philip R.

I met Lois Brenner at a networking group. She spoke on divorce and mediation. At the time I was not in need of a divorce attorney but was so impressed I kept her information. Two years later I hired Lois Brenner and I am finally separated from a man who nearly destroyed my life. Although we were able to do this with her in mediation, it was not easy for me. She really kept me strong, and on top of myself. She was helpful with both of us, and encouraged each of us when needed. It was much better than going through the court system. It took a lot less time and saved us money too. I can’t say enough about her. She is a special attorney. I tell everyone who will listen how special she is.- Pilar
