Grandparents' Rights

New York Grandparents’ Rights Lawyer

Seeking Visitation Rights? Call Lois M. Brenner, Esq. for Help.

For most grandparents, the idea of being unable to see their grandchildren is inconceivable. In reality, however, thousands of grandparents have faced the loss of their visitation rights. While some have successfully negotiated for the right to see their grandchildren, others have had to learn to live without regular contact. Currently, there is no uniform law in the United States regarding grandparents’ visitation rights – and, unfortunately, it is unlikely that there will be one in the near future.

If you need help seeking visitation with your grandchildren in New York, please do not hesitate to contact our New York family law attorney, Lois M. Brenner, Esq. You can reach our office at (646) 663-4546.

Grandparents’ Rights Are Decided By Each Individual State

Family matters are left up to the states to decide, and while some states have statutes providing for grandparent visitation, it does not make winning a case simple or easy. State laws regarding this issue vary from permissive to stringent, and many judges will consider case law when ruling on matters of grandparents’ rights. The Supreme Court case that relates to grandparents’ rights is Troxel v. Granville, which involved the right of third parties to seek visitation with children in Washington State.

In this case, Troxel v. Granville, the Supreme Court ruled that the statute was overly broad. As it had been written, the statute required only that such visits be in the best interests of the children. For this reason, the court decided that the statute violated a parent’s right to make decisions regarding the care, custody, and control of their children.

    “Lois is the absolute best”
Finding my way to Lois was the best thing that could have happened during my very contentious divorce. Lois took on my case with a level of care that has been above and beyond. She has been an incredible advocate for me, both legally, guiding me through this difficult process with knowledge and wisdom, and also personally, helping give me strength and support to stand up to my very aggressive ex husband. Lois is a gift, and I am so grateful to her and for the future she is helping to make possible to myself and for my son.

    “LOIS AND MATT ARE LIT!”
You two are really the dynamic duo! I can’t thank you both enough for the incredible job you did on my case. As a young career woman and working mother of a toddler I could not have been in better hands. You really toughened me up and guided me when I was feeling really lost. I was afraid of my husband’s clever antics but you worked hard on my case and encouraged me to fight. The settlement I received exceeded my expectations. You both listened, always returned e-mails, phone calls and even reached out to me on the weekends when I was having trouble. If anyone is going through a divorce and needs the best people to fight for you call Lois and Matt. It was the best thing I ever did. There are no words to express how grateful I am.

    “We love Lois!”
What a gem! Lois Brenner is the best out there by far... She got my husband and I right away. Listened, guided, let me cry, and never gave up on us during our mediation sessions. It was not easy but she made it possible. Even my husband liked her and agreed to mediate after we had lots of arguments. Thank you Lois. I already recommended you to my cardiologist. Have a happy, productive New Year.

“Lois Brenner is a Warrior for men”
When I first decided to hire a divorce attorney, I thought a male attorney would be best. Lois Brenner really surprised me. Although she has written a divorce book on women’s rights, she is totally an advocate for men as well. She really understood how much I loved my kids, and listened and understood all the horrible things my wife was doing to destroy their relationship with me. She didn’t miss a beat and really went to bat for me. She reached out to my wife’s attorney every time my wife made any attempt to disrupt my visiting our kids and always demanded the best results. She made herself available, even when she was on vacation! Lois has been there every step of the way in these difficult circumstances. I highly recommend her.

    “Brenner Divorce Method really works!!”
I had read about Lois’ unusual divorce method in one of her blog posts. It was refreshing to see someone was working with the psychological issues in divorce. My husband is bipolar and getting him to agree to a divorce and commit to the process was tough. When we met with Lois she really understood him. She immediately identified his mental health issues, and because she has a psych background, she was empathetic to his needs and was skillful at guiding him through her divorce mediation process. It took a while but she really got us to a point where we could actually discuss things without my husband blowing up. Her method is unique and it really helped in our situation. She actually recommended a great psychiatrist who changed my husband’s meds at her urging (she has a medical degree too), and my husband is coping much better. We can’t thank her enough for her compassion and advice! If you need a divorce attorney, especially if mental illness is a part of the fabric of your marriage, go see Lois! Thanks Lois 
