“Fault” and “No-Fault” Divorce in New York
In New York, a couple may file for divorce under “fault” or “no-fault” grounds.
In order to establish “fault” in a divorce, the filing spouse must be able to show one of the following:
- Abandonment for at least one year
- Incarceration for at least three consecutive years
- Cruel and inhuman treatment (such as mental or physical abuse)
- Adultery
“No-fault” divorce means that neither spouse is holding the other responsible for the divorce. Rather, a couple only has to show that their marriage has been irretrievably broken for six months or more.

I had read about Lois’ unusual divorce method in one of her blog posts. It was refreshing to see someone was working with the psychological issues in divorce.
