Postnuptial Agreements

Postnuptial Agreements in New York

What Is a Postnuptial Agreement?

A postnuptial agreement is a legally binding contract between two spouses that is created after they are already married. Like a prenuptial agreement, this contract would be used to settle the couple’s affairs and assets in the event of a divorce or separation. It may spell out how the couple’s property will be divided, who will get custody of the children, how much spousal support will be awarded, etc. When creating a postnuptial agreement, both spouses should hire their own legal representation.

Why Would a Married Couple Create a Postnuptial Agreement?

A married couple may choose to create a postnuptial agreement for a number of different reasons. For example, they are used by some marriage therapists and attorneys to promote harmony in a troubled marriage. Other times, married couples will create a postnuptial agreement to help resolve issues in their marriage by removing a source of disagreement over finances, assets, children, chores, etc.

Another reason why some couples will enter into a postnuptial agreement is to account for a change in the financial status of one or both spouses. Changing careers, receiving an inheritance, experiencing a change in investment income or selling a business are all potential reasons for creating a postnuptial agreement. For some, this agreement can help manage conflict and deflect a possible divorce. We can give you suggestions about how to have this discussion.

“"Finally a parenting agreement we can live with" :)”
Thank you Ms. Brenner! It was a rough summer trying to get our parenting agreement together.but you really helped. My ex-husband and I fought all summer about what the children's schedule would be once school started. Your endless guidance and productive sessions with us made all the difference. You straightened us out with your sound, caring advice. We both feel better now. Our kids feel better too. Thank you, thank you. We hope you had a great summer. We will recommend you highly to anyone needing a family law attorney.

“Lois Brenner is a Warrior for men”
When I first decided to hire a divorce attorney, I thought a male attorney would be best. Lois Brenner really surprised me. Although she has written a divorce book on women’s rights, she is totally an advocate for men as well. She really understood how much I loved my kids, and listened and understood all the horrible things my wife was doing to destroy their relationship with me. She didn’t miss a beat and really went to bat for me. She reached out to my wife’s attorney every time my wife made any attempt to disrupt my visiting our kids and always demanded the best results. She made herself available, even when she was on vacation! Lois has been there every step of the way in these difficult circumstances. I highly recommend her.

“My husband and I are grateful :)”
Everything you said about mediation was true. My husband and I really connected in a positive way working out the details of our divorce in mediation with you. The arguing was endless but we finally heard each other. You have a lot of patience. The property discussions made everything so emotional. You kept us focused and stopped us from rehashing the past. We tell everyone about you. Hopefully none of our friends will divorce but if they do we will tell them they need you.

“I'm grateful you did not give up on us.”
I just wanted to take a moment to personally thank you for the wonderful job you did mediating our separation agreement and putting this document together. You not only saved us hundreds of thousands of dollars but helped avoid what would have been a disastrous future in court. I'm grateful you did not give up on us. If I ever am involved in another situation like this, and I hope I never am, I would certainly recommend your services.

    “"High Net Worth Professionals"”
I am a highly successful money manager and before meeting Lois Brenner, hiring a divorce attorney was a disaster. Two previous divorce attorneys really wasted my funds, and had no savvy when it came to asset and property distribution. Lois Brenner finally fixed the mess I was in. She and her team of financial experts, including attorney Matthew Ehrlich were able to prepare an asset and property distribution that was realistic, keeping in mind tax ramifications, and important distributions and allocations. They negotiated a thorough and financially sound divorce settlement. If you have a lot of assets, just any divorce attorney won’t do. You really need someone with a lot of knowledge. Lois Brenner and Matthew Ehrlich were really impressive. Thanks!!

    “Remarkable lawyer and lady!”
Lois Brenner is a remarkable attorney and compassionate advocate for dads. She guided me when I was confused and didn't know what to do to get shared custody of my daughter. She encouraged me to stay strong and to fight, and she negotiated a much better custody arrangement than my previous lawyer. What great attorney. Thank you Ms. Brenner
