All divorce attorneys are not created equal. I receive calls all the time
from unhappy spouses who are not happy with the non-performance of their
divorce attorney.
Some of them feel their lawyer doesn’t know what he/she are doing,
and others never hear from their attorney and have no idea what’s
going on in their case. For others the case has been going on for years
and nothing has been accomplished.
Whatever the reason, if you are not happy with your divorce lawyer, and
they’re not doing a great job for you, it’s time to divorce
your divorce attorney!
Every profession has talented people. But there will also be some professionals
who are lazy, not assertive, or simply just not good at what they do.
When it comes to your divorce, you need the best, most talented, highly
motivated attorney, and more importantly an attorney who will be the right
fit for you.
If you have already signed a contract, and sadly hired a dud, it’s
time to get rid of your lawyer and you can probably get your unused retainer back.
As a dedicated and highly skilled divorce lawyer and mediator, I can tell
you that having accomplished, highly motivated representation when divorcing
is the key to getting the best possible settlement for you and your family.
When it comes to your future, and that of your family, there is no room
for mistakes.
Here are important reasons to change your divorce attorney today:
1. You attorney doesn’t return phone calls or respond to emails.
You are entitled to prompt communication with your attorney. Yes, they
are busy, and you are not their only client, but they should respond to
you in a timely fashion. You deserve to be heard and to have your questions
answered, and to be advised on the progression of your case. They should
not take on more business than they can handle!
2. The attorney you hired is not equipped to handle your case.
Some cases become complex and if you are a high net worth client, you may
require a divorce attorney with a strong financial background. Depending
on the scope of your case, you may need a divorce attorney who is a highly
skilled negotiator or seasoned litigator. Not all attorneys are created
equal. If you feel your attorney lacks the expertise your case requires
you may not get the settlement you deserve!
3.
Your attorney is a mess!
If your attorney never seems to be prepared, or on top of what is going
on in your case, you’re in trouble. This can really be a problem,
and negatively affect the outcome of your case when they show up unprepared
for court. If this happens to you, don’t walk, run!! Your lawyer’s
disorganization should never waste your time, money or jeopardize your
case or your settlement.
4. You don’t agree with your attorney’s advice.
Although you are probably not an attorney, and should take your lawyer’s
advice, your attorney still needs to listen to your wishes. If you feel
your attorney is pressuring you to accept a settlement that is not comfortable
for you, you may have a problem. After all, it is your life, and also
your decision.
If your attorney can’t adequately explain the reason for his/her
advice, and the settlement offer is not in alignment with what you feel
is fair, you may want to consider at the very least a consultation with
another divorce attorney. My advice? Get a second opinion! Call us!
